Who Must File & Statutory Thresholds
All regular registered taxpayers registered under the Goods and Services Tax (GST) law must file Form GSTR-9 for every financial year, subject to the following statutory turnover limits prescribed by the Central Board of Indirect Taxes and Customs (CBIC):
- Turnover up to ₹2 Crores: Optional filing exempted by CBIC notifications for small taxpayers; however, filing is recommended if significant ITC spillover or outward tax adjustments require formal recording.
- Turnover above ₹2 Crores up to ₹5 Crores: Mandatory filing of Form GSTR-9 (Annual Return). Failure to file attracts automatic daily late fees under Section 47.
- Turnover above ₹5 Crores: Mandatory filing of both Form GSTR-9 AND Form GSTR-9C (Reconciliation Statement). GSTR-9C is a self-certified reconciliation between the taxpayer's audited annual financials and the GST annual return.
- Composition Dealers: File Form GSTR-4 (different statutory schedule). Casual taxable persons, input service distributors, and non-resident taxable persons are exempt from GSTR-9.
